they have an EU Certificate of Conformity saying they are legal (regardless of whether it breaches our C&U Regs)

That's one of the (many) annoying things about bloody EU regs - many cars have front side lights flanking the grille (Merc W210 E class, most BMW's, various Italian things etc) which comply with the EU regs thus allowing them to be sold all over Europe, but they do not comply with UK C&U regs which  require sidelights to fitted to the extremities of the vehicle (i.e. all 4 corners) so the car has visible lights from whatever angle it is viewed at. This is primarily the reason that P2 Volvos have the 'in bumper' orange lights, although they are the wrong colour to comply with UK regs. Technically 340's, 440's, 850's and Mk2 960's don't comply at all...!!

Contacted askthepolice who gave me a quick simple reply answering my question today
heres their answer for future use:

"Additional LED lights would be classed as novelty lights which are OK
providing that they do not replace existing obligatory lights ( which have
to comply with EC standards) . They must not flash or move and cannot be
red at the front of the vehicle."

this came from: pnld@westyorkshire.pnn.police.uk

So in short, if your not replacing lights with them, then your ok
